    Dietz & Watson, Inc. Case Update

    Dietz & Watson has agreed to attend a mediation, where a third-party neutral will help us try to reach a settlement.  We have scheduled the mediation for November 29, 2018.  In the meantime, we will be exchanging information with Dietz to help us prepare for the mediation.  If you have any questions, please contact the case clerk, Danielle Kahler, at (612) 256-3214 or via email at dkahler@nka.com.

    Dietz & Watson, Inc. – Overtime Lawsuit - Update June 7, 2018

    On May 17, 2018, we won our motion requesting to send notice of this action to those who have not already signed up.  On June 5, 2018 we mailed official notice of the lawsuit to current and former sales merchandisers who worked for Dietz & Watson any time since June 5, 2015.  Current and former sales merchandisers who have not already signed up now have until August 4, 2018 to join the case.  If you know anyone interested in joining, please remind them of this deadline.     Sales Merchandisers Represented by Nichols Kaster, PLLP File Overtime Lawsuit Against Dietz & Watson, Inc.

    Two former employees of Dietz & Watson, Inc. filed a lawsuit on August 21, 2017, in the United States District Court for the Western District of Washington alleging violations of federal overtime law. The named plaintiffs, both former sales merchandisers, bring these claims individually and on behalf of similarly situated employees who worked for Dietz & Watson, Inc.

    The Complaint alleges that Dietz & Watson misclassified sales merchandisers as exempt from overtime pay by paying them a salary but overtime wages. The case is filed as a Fair Labor Standards Act collective action and Washington class action, and the named plaintiffs seek unpaid overtime wages and double damages. Plaintiffs also seek reimbursement for missed meal and rest breaks for the Washington Class.

    Plaintiffs' attorney Rebekah L. Bailey of Nichols Kaster, PLLP explained, “These employees work long hours on the road merchandising products at grocery stores. They should be fairly compensated when they work overtime doing so."

    Plaintiffs are represented by Rebekah L. Bailey and Jason D. Friedman from Nichols Kaster, PLLP, which has offices in Minneapolis, Minnesota and San Francisco, California.

    The case is entitled, Rozeboom et al v. Dietz & Watson, Inc., No. 2:17-CV-01266 (Western District of Washington).
