Peterson and Hooper et al v. Medtronic; Court File 2:17-cv-02457

On September 11, 2017, Plaintiffs filed their first amended complaint against Medtronic in federal court in the Western District of Tennessee. The plaintiffs, two female employees of Medtronic, bring claims for gender discrimination in pay and promotions. They bring their case individually and on behalf of all other similarly situated women, including current and former female employees managed or employed by Medtronic in the State of Tennessee who worked there at any time within three years prior to filing the complaint. The complaint alleges that Medtronic discriminates against female employees through its policies and practices concerning job assignment, career advancement, performance evaluations, promotion, and compensation.

    Medtronic – Equal Pay and Gender Discrimination - Update March 16, 2018

    On March 3, 2018, we filed a motion for conditional certification requesting that the court allow us to send notice of the lawsuit to other women who worked for or were managed by Medtronic in Tennessee within the last three years.   Medtronic’s response to our motion is due on April 3, 2018, after which we will wait for a ruling from the Court. In the meantime, we are continuing through the discovery phase of litigation, which is the fact-exchanging period of the case where we are exchanging data and information with Medtronic to help prove our case.

    Female Employees Represented by Nichols Kaster, PLLP File Class and Collective Action Against Medtronic for Gender Discrimination in Pay and Promotions

    On June 30, 2017, two female employees of Medtronic filed a complaint in federal court in the Western District of Tennessee. The plaintiffs bring claims for gender discrimination in pay and promotions. They bring their case individually and on behalf of all other similarly situated women, including current and former female employees of Medtronic who worked there at any time within three years prior to filing the complaint. The complaint alleges that Medtronic discriminates against female employees through its policies and practices concerning job assignment, career advancement, performance evaluations, promotion, and compensation.

    Medtronic is a Minnesota medical technology company with various locations around the country, including Memphis, Tennessee. According to its website, Medtronic "is the global leader in medical technology - alleviating pain, restoring health and extending life for millions of people around the world."

    Plaintiffs' attorney David E. Schlesinger stated, "Women at Medtronic, and throughout this country, are entitled to equal pay for equal work. Our clients are committed employees of Medtronic. Every day they go to work and perform the same work as men. Nevertheless, like many other women throughout this country, they see themselves not being compensated equally to or promoted as frequently as the men with whom they work. This case addresses these concerns for our clients and other similarly situated female employees of Medtronic."

    The case was filed in federal court in the District of Tennessee, Court File No. 2:17-cv-02457. Plaintiffs are represented by David E. Schlesinger, Rebekah L. Bailey and Michelle L. What Time Frame Does This Case Cover?

The statute of limitations in cases such as this typically allows employees to recover unpaid wages for up to 2 years of signing up for the lawsuit (three years if we can prove the company willfully violated the law).

Do I Have To Pay Anything?

You do not have to pay anything to our firm out-of-pocket if you join the lawsuit. We are handling this case on a contingency basis. This means we will only be paid if the lawsuit is successful in obtaining relief through a settlement, final judgment, or award, and our payment will come only out of that settlement, final judgment, or award.

How Long Will This Case Take?
