No Place Like Home, Inc.

Together with the Donati Law Firm in Memphis, Tennessee, we currently represent nurses who work or have worked at No Place Like Home, Inc. (“NPLH”). We allege that NPLH misclassified nurses as independent contractors, and as a result, it denied nurses of legally required overtime premiums for all hours they worked over forty during a work week.

This is not a class action. NPLH’s agreement with nurses requires that all disputes be arbitrated rather than resolved in court. Therefore, our clients have all filed demands with the American Arbitration Association (“AAA”). Soon after we began filing demands with the AAA, NPLH filed for bankruptcy. NPLH’s bankruptcy plan was confirmed on June 17, 2016 and it provides payments for 100% of nurses’ full, liquidated two-year claims through a bankruptcy-plan payment process. This plan covers all of NPLH’s nurses who worked overtime during the relevant period. The final payment is due to be completed in approximately 2020.

Meanwhile, NPLH continues to dispute that it willfully violated the law and refuses to compensate nurses for an additional (third) year of work. We will be going to trial for these damages for our clients in bankruptcy court, likely in late 2017 or early 2018. This trial will not include nurses outside of our clients.
