Bisaccia v. Revel Systems, Inc., Case No. 4:17-cv-02533 (Northern District of California)

On May 5, 2017, we filed a collective action complaint on behalf of all inside sales personnel employed by Revel Systems, Inc. We allege that Revel Systems misclassified its inside Sales Executives, Account Executives, Enterprise Sales Executives, and other inside sales employees as exempt from the Fair Labor Standards Act’s (FLSA) overtime requirements, and as a result, failed to pay them overtime wages when they worked more than forty (40) hours in a workweek. This case seeks to recover back pay and liquidated (double) damages for these employees.

    Revel Systems Inside Sales Representatives – Unpaid Overtime Lawsuit - Update April 9, 2018

    The period to join the case and assert FLSA claims has closed, and 151 individuals have opted-in to the case. Additionally, we filed a request to file a First Amendment Compliant in order to add class claims under California and New York state law. Our goal is to certify the case as a class action, so other inside sales representatives would also be included. Am I eligible?

To be eligible for this case you must have:

• Worked as an inside Sales Executive or had a similar job title for Revel Systems within the past three years; and

• Worked overtime (you do not need any records of your overtime hours worked to be eligible).

Which Locations Are Included?

You must have been employed by Revel Systems as an inside Sales Executive, Account Executive, Enterprise Sales Executive, or other similar inside sales position, anywhere within the United States.

What Time Frame Is Covered?

There is a federal statute of limitations in this case that allows employees to recover pay for overtime hours worked within two years of signing up for the case. If we can prove the company willfully violated the law, the statute of limitations may be extended to three years.

Do I Have To Pay Anything?

You do not have to pay anything to our firm if you join the case. We are handling this case on a contingency-fee basis. This means we will only be paid if the case is successful in obtaining relief either through a settlement or a final judgment, and that payment for our fees and costs will only come out of that settlement or final judgment.

How Do I Prove I Worked Overtime?

We will request records of all of the hours you worked from the company. Where the employer does not keep accurate time records, most courts permit the employee to make a good faith estimate of overtime hours. This means that you do not need to have proof of the hours you worked in order to make a claim.

How Long Will This Case Take?

The length of an action such as this varies from case to case. Typically, these types of cases last one to two years.
