On October 22, 2019, we filed a complaint against ABC Inc. d/b/a ABC Seamless (“ABC”) on behalf of Bree and Rory Klawien and a proposed class of Minnesota homeowners. The lawsuit alleges that ABC sells siding with a lifetime transferable warranty, but that it nevertheless routinely refuses to allow the warranty to be transferred and purports to rely upon a transfer limitation that does not exist. This leaves the homeowners without recourse through their warranty when their siding prematurely cracks and peels. The Court has denied ABC’s motion to dismiss the case. This case seeks to represent a class of all Minnesota homeowners with ABC Seamless siding that was installed by a previous owner, and whose warranty claim ABC has denied because the warranty was not transferred within the first 30 days after the homeowner purchased the home. This case also seeks to represent an injunctive relief class on behalf of all Minnesota homeowners with ABC Seamless siding that was installed by a previous owner and that is subject to a transferable warranty. What is a Class Action?
