Nichols Kaster is proud to represent three African-American students, and their families, who are advocating for critical changes at the Duluth Public Schools Academy (also known as Duluth Edison Charter Schools) that will ensure a safe, healthy and non-discriminatory learning environment for all students. The students in the lawsuit, filed in April in Minnesota federal district court, have experienced pervasive racism, discrimination and harassment at the school from both their fellow students and the school’s faculty. Despite continuous complaints from the students and their families, however, the Charter Schools have failed – and continue to fail – to take any proactive steps to address the dangerous environment students have endured on school officials’ watch. Our legal team is working with these courageous students to bring accountability to the Charter Schools that will improve student safety and well-being while promoting changes that ensure every student can attend school, and learn, without fear for their safety or discrimination because of who they are.

The lawsuit alleges that the Charter Schools violated the students’ constitutional rights, Title VI of the Civil Rights Act of 1964, and the Minnesota Human Rights Act.

    Plaintiffs Defeat School District’s Motion for Summary Judgment

    On March 16, 2022, Judge Donovan Frank of the U.S. District Court for the District of Minnesota denied the school district’s motion for summary judgment on Plaintiffs’ claims. The order is temporarily filed under seal.

  • June 16, 2019

    Fourth Family Joins Lawsuit Against Duluth Edison Charter Schools

    Nichols Kaster and co-counsel Public Justice filed an amended complaint on behalf of four students on June 11, 2019, alleging Duluth Edison discriminated against the students based on race. In addition to adding another student plaintiff, the amended complaint also includes additional claims against the school.

    Lawsuit Alleges Racial Discrimination at Duluth Edison

    The Duluth News Tribune wrote an article this morning detailing a case brought by Nichols Kaster on behalf of three African-American students, who have suffered racial discrimination at Duluth Edison Charter Schools.

    The article quotes partner Rebekah L. Bailey as explaining: "This is not just about one young kid being inappropriate or mean to another young kid. The troublesome behavior keeps going after that."  She continued: "We are talking about the failure of the school to take this seriously or to treat kids fairly or retaliate against African American students who complain too much about the way they are treated. I would say that's the crux of the problem here is the school's response to this behavior."
