Advisory Jury Trial Granted in Nichols Kaster ERISA 401(k) Action Against Fidelity

A federal judge has granted plaintiffs’ request for an advisory jury in a suit against Fidelity Investments relating to its 401(k) plan.  Although the court held that the plaintiffs did not have an automatic right to a jury trial, it granted plaintiffs’ request for an advisory jury, noting that “citizen juries play a vital role in our democracy.”  For more information, click here to read a recent Bloomberg article.
