GEICO Update Nichols Kaster

In May 2013 we appeared in front of the United States Court of Appeals for the Fourth Circuit to defend the District Court’s holding that GEICO misclassified Security Investigators and owed them overtime pay. We also challenged the District Court’s holdings related to damages issues. In June 2014, the Court of Appeals dismissed the appeal on technical grounds, inviting the parties to resolve the technicality and then to re-file the appeals. Over the last three months, we have been working with GEICO’s attorneys to resolve the technicality, which involved a detailed review of each Plaintiff and Class Member’s employment data and earnings. We hope to have the issue resolved within the next few weeks, and to re-file the appeals by the end of October 2014. If the Court of Appeals permits, we may be able to speed the appellate review process by simply submitting the previously filed briefs, rather than completing entirely new ones. In any event, we expect a ruling from the Court of Appeals at some point in 2015. Thank you for your patience.
