In a fiercely contested case, and after nearly four years of litigation, a federal jury in Memphis, Tennessee, delivered a verdict in favor of cable installers on October 5, 2011. The jury found that the technicians’ employers, FTS USA, LLC and UniTek USA, LLC, willfully violated federal law when they denied the technicians their overtime pay. The company unsuccessfully attempted on several occasions to disband the approximately 300 technicians in the case, but because of the similarities in their claims, the jury’s verdict applies to the whole class of technicians.
Plaintiffs’ Counsel William B. Ryan stated, “The jury's verdict is loud and clear; employers such as FTS can't knowingly work employees off-the-clock and expect to get away with it.” Plaintiffs’ Counsel Rachhana T. Srey added, “This is a gratifying win for our clients. They’ve waited a long time to be paid what they earned, and we are very happy with the result.”
