Do Not Call Violations & Unwanted Calls, Faxes, or Text Messages

You have probably received calls to your cell phone from unknown numbers with pre-recorded messages. Calls like this are a nuisance -- they interrupt your day and soak up your time. Under federal law, those calls may be illegal. Companies may be liable to pay a fine for every illegal call that was answered, no matter how quickly you hung up. Unwanted faxes and text messages may also be illegal.

For example, if you signed up for the National Do Not Call Registry, it is illegal for any telemarketer to call you unless you specifically agreed to receive calls from them. The Federal Communications Commission has fined companies millions of dollars for calling people on the Do Not Call list.

If companies don’t face consequences for bothering consumers with annoying phone calls, they will keep doing it. Our attorneys will work with you to hold companies accountable for the disruption these calls have caused you, and to send a message to companies that this behavior is unacceptable.

Unwanted Communications Details

The Telephone Consumer Protection Act (TCPA) prohibits companies from making certain kinds of calls. Under the law, it is illegal for a company to call you:

  • Using an auto-dialer if you haven’t given your permission to be called.
  • Between 9 p.m. and 8 a.m.
  • Without identifying who is calling.
  • If you are on the National Do-Not-Call list.

Federal law imposes fines on companies that make illegal calls or send illegal text message and faxes. If you received text messages or faxes from an automated sender without giving them permission, you may be eligible for damages.
