Unauthorized Credit/Debit Card Purchases Details

You may not be legally responsible for unauthorized charges/purchases made after your credit or debit card is lost or stolen. Federal laws such as the Electronic Funds Transfer Act and the Fair Credit Billing Act dictate a consumer’s liability for unauthorized credit/debit card purchases.

A customer who is the victim of identity theft, or who had any unauthorized purchases made on their card, cannot be held responsible for payments above a certain threshold. Unfortunately, banks or credit card companies are sometimes unwilling to reimburse customers for charges made using a lost or stolen card.

Examples of Unauthorized Credit or Debit Card Purchases

  • If you report an unauthorized charge made using your debit card within two business days, you are liable for only $50. If you report the unauthorized charge between two and 60 calendar days, you are liable for only $500.
  • If the charge was made using a credit card, you are liable for only $50.
  • You are not liable at all for charges made to a credit card after you reported the card lost or stolen.
