Unauthorized "Auto-Renewals" and Cancellation Fees Details

Auto-renewals are often a convenient way to provide customers with uninterrupted service without needing to renew each month. However, if auto-renewal policies are unclear or deceptive, it can lead to unnoticed charges even after you stop using the product or service, and can even cause long-term damage to your credit score. Likewise, undisclosed cancellation fees can increase the cost of a product or service beyond the price that you would otherwise have been willing to pay.

Because of the potential for abuse of auto-renewals and cancellation fees, many states have taken steps to protect consumers. For example, some states have passed laws banning "opt-out" automatic renewals, where a customer needs to go out of their way to cancel automatic renewal. In those states, customers instead need to be given the option and affirmatively "opt-in" to an automatic renewal agreement.

Examples of Unauthorized "Auto-Renewals"

The laws governing automatic renewals vary by state. Generally, you may be entitled to compensation if:

  • A company charged you for a product or service for which you did not opt-in to an automatic renewal agreement.
  • The terms of the automatic renewal agreement as presented to you were not clear and conspicuous.
  • You were not provided with a separate acknowledgement of having signed up for automatic renewal.
  • You were not given ample notice of changes to the terms of your automatic renewal.
