Many software companies employ implementation consultants: individuals who provide on-site and remote services to new clients during the implementation process, including assisting with setting up applications, gathering information from clients for data conversion, assisting with the roll-out process and providing training to the client.
We are currently investigating whether individuals working as implementation consultants, and other similar titles, for Fiserv were properly paid overtime when they worked over 40 hours in a work week. Specifically, we are investigating whether Fiserv may have misclassified these workers as exempt, paying them a salary and no additional overtime pay for their overtime hours worked. Under federal overtime laws, employees may be eligible for overtime wages, even if they are paid a salary, depending on their primary job duties. Our understanding of the job duties typically performed by implementation consultants has led us to believe they may be misclassified as exempt, and as a result, may be entitled to overtime pay.
