Our firm is currently investigating whether certain employers in Minnesota require servers, wait staff, and other employees to share their tips with one another. This practice is commonly referred to as “tip pooling, “tipping out,” or paying into a “tipshare.” Minnesota law allows employees to voluntarily share their tips, but forbids management from taking money from the tip pool, requiring certain employees to share tips, or participating in any agreement for certain employees to share tips.
If, during the past three years, you have worked for a restaurant or bar in Minnesota that has required you to share your tips, you may be eligible to make a claim for damages. If you have questions about this investigation or would like to discuss your potential claims, please contact us.
