Employees File Lawsuit Against Monro Muffler for Alleged Unpaid Wages

Portland, Maine (PRWEB) On November 20, 2012, a Complaint was filed by technicians and managers who worked in Monro Muffler Brake, Inc.’s stores, which sold automobile tires and performed alignments. The case was filed in federal court in the District of Maine. The Complaint alleges individual, collective, and class action allegations under the federal Fair Labor Standards Act and Maine’s state wage and hour laws. Specifically, the Complaint alleges that Monro Muffler violated federal and state wage and hour laws when it failed to properly calculate the overtime pay that it paid to its non-exempt hourly paid technicians. The technicians were paid “spiffs” for each tire installation and alignment they completed, but the “spiffs” were improperly excluded from the technicians’ regular rate calculation, according to the Complaint. The Complaint also alleges that managers, who were also non-exempt and paid on an hourly basis, were not properly paid for all of their hours worked because they were required to perform work after they clocked out for the day and worked through their lunch breaks.

The individual Plaintiff, Christopher Michaud, is pursuing his claims on behalf of two collective classes (one for technicians and one for managers) and two Rule 23 classes (one for technicians and one for managers). The Complaint alleges that there are other “similarly situated” technicians and/or managers located throughout the country who may be eligible to participate in the case and assert similar claims.

One of the Plaintiff’s attorneys, Rachhana T.
