On September 17th, the parties met for a status conference before Judge Timothy S. Black, who confirmed the remaining case deadlines would remain intact. Ten days later, we asked Judge Black to certify a class of Ohio MLOs for violations of Ohio state overtime law. Fifth Third has until October 22, 2012 to respond. If the Court grants our request, all MLOs in Ohio employed between February 11, 2009 and January 3, 2011 will receive another notice about the case. At the same time, the discovery phase of the case continues until January 2013. During this time we are preparing for trial and pre-trial motions. We need your help during this phase, so please be sure to return our calls and emails. After discovery closes, trial preparation will continue for a few months. Trial begins in Cincinnati on June 3, 2013.
