The deadline to join the case was February 18, 2013, and over 200 former RAC Contractors joined the lawsuit! This is an outstanding response.
As you know, we initially filed this lawsuit against MMC Group, LP, C.D. Mitchell & Co. and Mir Mitchell & Co., LLP. Based on representations we received from the defendants, we agreed to dismiss MMC Group and Mir Mitchell from the lawsuit, leaving C.D. Mitchell as the sole remaining defendant in this case. This will not have a substantive effect on your case.
On April 4, 2013, we flew to Houston, Texas to attend mediation with C.D. Mitchell to attempt to settle the case. The mediation was very productive, but ultimately we were unable to get C.D. Mitchell to agree to a settlement amount we thought was fair. Although we are still working with the mediator and C.D. Mitchell’s attorney to settle the case, in the meantime we will proceed with the lawsuit, which means we are now entering the “discovery” phase of the case.
