Judge Appoints Special Master & Stays Trial

On March 3rd, both parties met before Judge Vratil to discuss various pending motions for this case. Following this hearing, the court informed the parties that it was considering a new course of action before trial. The court proposed appointing a special master and a neutral expert to learn the technical issues in this case, and to try to identify the differences between the parties’ experts’ damage calculations.  The court also suggested the neutrals could assist it in making decisions on the pending motions, and that a neutral expert could assist the jury at trial.

On Monday, April 14, 2014, the Court made a final determination and appointed a special master.  The next day on April 15, 2014, the Court issued a related order, postponing our trial.  The Court did not set a new trial date, and it will likely be some time before we have a better idea as to the length of the delay.

The parties attended a telephone conference with the special master on April 24, 2014.  The special master is presently familiarizing himself with the details of the case by reading a lot of court documents.  The special master is also coordinating with the parties to select a technical advisor.  We will update you with the progress the parties make in this special master process.  In the meantime, please contact our case clerk, Matt Yost, with questions or contact information changes.
