On November 20, 2013, the Court granted the Motion for Final Approval of Settlement Agreement. The Court found that the notice that was provided to all the FLSA Collective and Rule 23 Class members constituted the best notice practicable and that the settlement was fair, reasonable, and adequate in all respects.
Under the terms of the Settlement Agreement, Grande Cheese is required to provide Nichols Kaster with the settlement checks for all the collective and class members after the 30 day appeal period expires, which will be December 23rd. Once Nichols Kaster receives the checks, it will mail them out to all the collective and class members, which it expects to do by the end of the year.
