It is illegal for a company to discriminate against job applicants on the basis of gender, race, national origin, disability, and/or age. There are various ways discrimination can occur during the hiring process, potentially including through the use of artificial intelligence. Some companies use artificial intelligence to screen applicants and narrow down the applicant pool. For example, companies might ask job applicants to submit video interviews that are then reviewed by artificial intelligence. As another example, companies might ask applicants to play app-based games that use artificial intelligence to judge applicants’ personalities. This process may have the effect of discriminating against applicants on the basis of gender, race, national origin, disability, and/or age.
