On October 7, 2020, we filed a lawsuit on behalf of participants in the Motion Picture Industry Individual Account Plan, (the “Plan”). The lawsuit alleges that the Plan’s fiduciaries (the Defendants in the case) violated the Employee Retirement Income Security Act (ERISA) by failing to act prudently or in the interest of Plan participants and beneficiaries in managing the Plan’s investment options.

The lawsuit seeks to recover the Plan’s financial losses and other equitable relief. For a copy of the Third Amended Complaint, click here.

Case Updates

October 22, 2026

Plaintiff appealed the district court’s summary judgment decision in favor of Defendants, and on August 14, 2026 the U.S. Court of Appeals for the Ninth Circuit vacated and remanded this case back to the district court for further proceedings. This case has been reassigned to the Honorable Fernando L. Aenlle-Rocha.
