On July 9th, 2026, a former Case Manager filed an overtime lawsuit against Pinnacle Services, Inc. The Complaint alleges that while case managers are paid a salary for their work, they do not meet all of the required job duties under federal and Minnesota state law that would exempt and make them ineligible for overtime pay. The named plaintiff asserts individual claims and claims on behalf of other similarly situated Case Managers who were paid a salary and treated as exempt from overtime pay when they worked over 40 hours in a work week.
The plaintiff brought the case as a putative collective action under the federal Fair Labor Standards Act (“FLSA”) and a Rule 23 class action under the Minnesota Fair Labor Standards Act (“MFLSA”) and the Minnesota Payment of Wages Act (“MPWA”) seeking to recover unpaid overtime compensation, liquidated (double) damages, and other statutorily permitted relief for themself and others.

What Time Frame Does This Case Cover?
There is a federal time limit, called a statute of limitations, that allows an employee to recover unpaid wages for overtime hours worked within two years of the employee signing up to join the lawsuit by completing the consent form referenced above. If we can prove that KeyPoint willfully violated the law, the statute of limitations may be extended to three years.
