New Mexico Truck Driver Overtime Violations

Our firm is investigating whether employers such as logistics companies and others in New Mexico are paying proper overtime wages to truck drivers. We believe that truck drivers who work more than forty hours in New Mexico may be entitled to overtime pay under New Mexico state law. It does not matter if the company is headquartered outside of the state of New Mexico or if the truck drivers also spend some time driving in other states so long as they spend more than 40 hours per week driving within New Mexico. Additionally, truck drivers may still have a claim even if they are classified as an “independent contractor” depending on the amount of control the company exercises, and even if they are DOT-controlled and regulated.
