On 5/15/15, we filed our motion for FLSA conditional certification and Rule 23 class certification. The Magistrate Judge issued a report recommending that our motions be granted, which was great news. However, on 9/10/15, Safety Signs filed its objections to the Magistrate’s order. Our motion is now being reviewed by the District Court Judge, who will make the final decision on these issues. If our motions are approved, our case will be certified as a class action, and we will mail notice of this lawsuit to all laborers who worked for Safety Signs, giving them the opportunity to join the case. In addition to waiting for the Court’s order, we are in the “discovery” phase of litigation, which is where we gather evidence we need to prove our case. We are currently reviewing the evidence we have received from Safety Signs, and building our case against them.
