On September 4th, 2025, the law firm of Nichols Kaster – together with Virtue Law Group – filed a lawsuit on behalf of a proposed class of CareFirst and CVS Caremark enrollees diagnosed with obstructive sleep apnea. The lawsuit alleges that CareFirst and CVS’ exclusion of coverage for Zepbound to treat obstructive sleep apnea may violate ERISA (the Employee Retirement Income Security Act).
If you have been diagnosed with moderate to severe obstructive sleep apnea (apnea hypopnea index (AHI) equal to or greater than 15) and your health insurance has denied coverage for Zepbound, you may have a legal claim.
