On September 16, 2025, the law firm of Nichols Kaster – together with the law firms of Sirianni Youtz Spoonemore Hamburger PLLC and Saeed & Little LLP – filed a lawsuit on behalf of a proposed class of Anthem enrollees diagnosed with obstructive sleep apnea. The lawsuit alleges that Anthem’s exclusion of coverage for Zepbound to treat obstructive sleep apnea violates the Employee Retirement Income Security Act, which is known as ERISA.
