Transgender Healthcare Coverage

Some states, such as West Virginia, have Medicaid policies that explicitly exclude transgender healthcare coverage. These exclusions have the effect of banning insurance coverage for care like hormone therapy or gender-affirming surgeries, including top surgery and SRS. Coverage could be denied even when a doctor determines such care is medically necessary for a particular individual. Under certain federal and state laws, including the Affordable Care Act, covered entities are not permitted to discriminatorily restrict a transgender individual’s access to healthcare.  If you receive insurance through Medicaid and were denied care based on a transgender health exclusion, contact our Civil Rights and Impact Litigation Group.
