Some states, such as West Virginia, have state employee health plans and/or Medicaid policies that explicitly exclude transgender healthcare coverage. These exclusions have the effect of banning insurance coverage for care like hormone therapy or gender-affirming surgeries, including top surgery and SRS. Coverage could be denied even when a doctor determines such care is medically necessary for a particular individual. Under certain federal and state laws, including the Affordable Care Act, covered entities are not permitted to discriminatorily restrict a transgender individual’s access to healthcare.
