Nichols Kaster Files Overtime Lawsuit on Behalf of Mortgage Underwriters Against Branch Banking and Trust Company

On January 3, 2012, a former employee of Branch Banking and Trust Company (“BB&T”) filed suit in the Middle District of North Carolina under the Fair Labor Standards Act for unpaid overtime wages. The case was filed on behalf of mortgage underwriters nationwide who worked for BB&T within the last three years. The plaintiff alleges that he and other mortgage underwriters were improperly classified as exempt and denied overtime compensation.

Plaintiffs' attorney Matt Helland stated, "The law in this area has become clear – mortgage underwriters are non-exempt employees entitled to overtime. Most banks and mortgage companies have already changed their pay practices to comply with the law. We seek to get these employees paid the overtime wages they are due through this action."
