Filing a Sex or Gender Discrimination Claim in Minnesota

Meeting the right deadlines is one of the most important steps in preserving a discrimination claim. Under the MHRA, you must file a charge with the MDHR or bring a civil action in court within one year of the discriminatory act. Under Title VII, a charge must be filed with the EEOC within 300 days because Minnesota is an EEOC deferral state, meaning a state agency exists to handle the same type of claim.

One important change took effect on October 1, 2025: the MDHR and the EEOC no longer automatically cross-file charges with each other.
