In October 2014, the United States Court of Appeals for the Seventh Circuit held oral argument on the question of whether this case should be allowed to go forward. The Court of Appeals has not yet issued a decision but has invited the Department of Education to submit an amicus brief. We expect that a decision will be issued later this year.
