Employee Represented by Nichols Kaster, PLLP Files Overtime Lawsuit Against Killion Communications Consultants, Inc.

On September 23, 2015, an employee of Killion Communications Consultants, Inc. (“Killion”) filed a Complaint against the company in the Central District of Illinois seeking overtime pay. The named plaintiff, an outside plant engineer, brought the case on behalf of himself and all similarly situated employees nationwide who were paid “straight time” for all hours worked. Plaintiff’s complaint alleges that Killion paid the named plaintiff an hourly rate, but failed to pay him the legally required overtime premium of one and one-half times his hourly rate for the overtime hours he worked over 40 per week, in violation of the Fair Labor Standards Act.  The lawsuit seeks overtime premiums plus double damages.

Killion Communications Consultants, Inc. is a staffing company that contracts with telecommunications companies such as CenturyLink, AT&T, and Windstream to provide services that include the construction and maintenance of communications systems including voice, data, and fiber optics, within the telecommunications industry. It contracts to provide its services throughout Illinois, Michigan, Minnesota, Wisconsin, Iowa, Kansas, Colorado, and Wyoming.

Plaintiff’s attorney Jason Hungerford stated, “Killion Communications failed to abide by one of the most basic and fundamental requirements of the FLSA—pay your employees time and a half for their overtime. Our lawsuit seeks to hold Killion to that requirement.”

Plaintiffs are represented by Matthew H. Morgan and Jason P. Hungerford from Nichols Kaster, PLLP in Minneapolis, Minnesota. The case was filed in the Central District of Illinois, Court File No. 3:15-cv-03277.
