Kasten v. Saint-Gobain Performance Plastics Corp.
Nichols Kaster represented an individual employee all the way to the U.S. Supreme Court and received a favorable ruling, which clarified that the anti-retaliation provisions in the Fair Labor Standards Act protect employees against retaliation from their employer when they verbally complain about wage and hour violations.

5th Circuit for the U.S. Court of Appeals
Clark v. Centene Co. of Tex., L.P.
The Fifth Circuit of the U.S. Court of Appeals affirmed a favorable decision obtained by our attorneys, holding that a collective group of utilization review nurses working for an insurance company qualified to receive overtime pay under the Fair Labor Standards Act. Previously, after a bench trial, the district court awarded damages to the nurses and entered judgment in the total amount of $1,024,484.67. The court found that plaintiffs submitted sufficient evidence to create a just and reasonable inference as to overtime hours worked by the collective and awarded liquidated damages (double recovery).

Main v. American Airlines, Inc.
Nichols Kaster successfully staved off attempts to dismiss the claims of a class of current and former employees at American Airlines who participated in the company's 401(k) retirement plan. Shortly thereafter, the parties settled the case for a total of $22,000,000.

U.S. District Court for the Southern District of New York
Hart v. Rick’s Cabaret International, Inc.
Nichols Kaster represented a collective and class of 2,300 adult entertainers and successfully obtained a ruling that the entertainers qualified as employees, and not independent contractors, entitled to minimum wages under state and federal law. Our attorneys went on to achieve a strong $15,000,000 settlement for the class.
